Welcome to Plainify. These Terms of Service ("Terms") govern your access to and use of Plainify's website and services at plainify.app ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By using Plainify, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Plainify is a free web application that helps users create structured product specifications using the PLAIN (Product Language for AI Notation) format. The Service allows you to:

• Create and edit product specifications through a guided form interface
• Generate AI-enhanced documentation using Anthropic's Claude API
• Export specifications as markdown files for use with AI coding assistants
• Store your work locally in your browser

3. Eligibility

3.1 Age Requirements

You must be at least 13 years of age to use Plainify. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of any data you create and for all activities that occur during your use of the Service.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use Plainify to:

• Create legitimate product specifications for personal or commercial projects
• Generate documentation for software development purposes
• Export and share your specifications with team members or AI tools

4.2 Prohibited Uses

You agree NOT to use Plainify to:

• Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate specifications for illegal products or services
• Attempt to circumvent rate limits or abuse the AI generation feature
• Use automated systems (bots, scrapers) to access the Service excessively
• Interfere with or disrupt the Service or servers
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit malware, viruses, or any other malicious code

4.3 AI Generation Limits

The AI generation feature is subject to rate limits:

• 5 generations per 24-hour period
• 10-minute cooldown between generations
• Security challenges may be required for continued use

We reserve the right to modify these limits at any time.

5. Intellectual Property

5.1 Your Content

You retain full ownership of all content you create using Plainify, including:

• Product specifications
• Generated markdown files
• Any exported documents

You grant Plainify no rights to your content beyond what is necessary to provide the Service.

5.2 Our Service

Plainify and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. This includes:

• The Plainify name and logo
• The PLAIN format structure
• User interface design and code
• Documentation and guides

5.3 Open Source

Plainify is open source software. The source code is available under the terms specified in our GitHub repository.

6. Third-Party Services

6.1 Anthropic Claude API

The AI generation feature uses Anthropic's Claude API. By using this feature, you also agree to:

• Anthropic's Terms of Service
• Anthropic's Acceptable Use Policy

6.2 Data Processing

When using AI generation, your form content is sent to Anthropic for processing. We are not responsible for how Anthropic processes this data beyond what is specified in their privacy policy.

7. Disclaimers

7.1 "As Is" Service

PLAINIFY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT

7.2 No Guarantees

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Results from using the Service will be accurate or reliable
• The quality of the Service will meet your expectations
• Any errors will be corrected

7.3 AI-Generated Content

AI-generated content may contain errors, inaccuracies, or inappropriate material. You are solely responsible for reviewing and validating any AI-generated content before use.

8. Limitation of Liability

8.1 Exclusion of Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, PLAINIFY SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your data
• Damages resulting from any third-party services

8.2 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS (WHICH IS $0 FOR OUR FREE SERVICE).

8.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Plainify and its creators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create using the Service

10. Modifications to Service

We reserve the right to:

• Modify or discontinue the Service at any time without notice
• Change features, functionality, or pricing (if applicable)
• Impose limits on certain features or access

We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11. Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting to the website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

We will make reasonable efforts to notify users of material changes by:

• Updating the "Last Updated" date
• Posting a notice on the website for significant changes

12. Termination

12.1 By You

You may stop using Plainify at any time. Your locally stored data will remain in your browser until you clear it.

12.2 By Us

We reserve the right to suspend or terminate access to the Service for any user who violates these Terms or engages in abusive behavior.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at legal@plainify.app.

14.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in the United States.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Plainify regarding the Service.
